1. Agreement Acceptance

By booking a tour with Lipshand Luxury Tours ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and Lipshand Luxury Tours, a Canadian corporation operating under Travel Industry Council of Ontario (TICO) registration #50026291.

2. Booking and Payment Terms

2.1 Reservation Process

All bookings require a signed tour agreement and deposit payment. Reservations are confirmed only upon receipt of required deposit and acceptance by Lipshand Luxury Tours.

2.2 Payment Schedule

• Initial deposit: 25% of total tour cost due at booking
• Second payment: 50% of total tour cost due 90 days before departure
• Final payment: 25% of total tour cost due 30 days before departure
• Bookings made within 30 days of departure require full payment immediately

2.3 Accepted Payment Methods

We accept major credit cards, certified cheques, and wire transfers. All prices are quoted in Canadian dollars unless otherwise specified.

3. Cancellation and Refund Policy

3.1 Customer Cancellation

Cancellation fees apply as follows:

• 91+ days before departure: 10% of total tour cost
• 61-90 days before departure: 25% of total tour cost
• 31-60 days before departure: 50% of total tour cost
• 8-30 days before departure: 75% of total tour cost
• 7 days or less before departure: 100% of total tour cost (no refund)

3.2 Company Cancellation

Lipshand Luxury Tours reserves the right to cancel any tour due to insufficient enrollment, weather conditions, safety concerns, or circumstances beyond our control. In such cases, customers will receive a full refund or may transfer to an alternative tour of equal value.

3.3 Force Majeure

We are not liable for cancellations due to acts of God, natural disasters, government actions, terrorism, epidemic, or other circumstances beyond our reasonable control. Trip interruption insurance is strongly recommended.

4. Tour Inclusions and Exclusions

4.1 Included Services

Unless otherwise specified, tours include:

• Luxury accommodations as described in tour itinerary
• All meals and beverages as specified
• Ground transportation in premium vehicles
• Professional guide services
• All entrance fees and activity costs as listed
• Comprehensive travel insurance (terms apply)

4.2 Excluded Services

Tours do not include:

• International or domestic airfare unless specifically included
• Personal expenses including souvenirs, laundry, telephone calls
• Alcoholic beverages unless specifically included
• Gratuities for guides and service staff
• Travel documents (passport, visa fees)
• Additional travel insurance beyond provided coverage

5. Travel Requirements and Responsibilities

5.1 Documentation

Customers are responsible for obtaining and maintaining valid travel documents. International travelers must possess valid passports with appropriate validity periods.

5.2 Health and Fitness

Customers must disclose any medical conditions, dietary restrictions, or physical limitations that may affect tour participation. Some tours require moderate to strenuous physical activity.

5.3 Behavioral Standards

Customers are expected to conduct themselves respectfully toward other participants, guides, and local communities. Lipshand Luxury Tours reserves the right to remove customers whose behavior disrupts the tour experience.

6. Liability and Insurance

6.1 Limitation of Liability

Lipshand Luxury Tours acts as an agent for transportation, accommodation, and activity providers. Our liability is limited to the tour cost paid. We are not responsible for acts or omissions of third-party service providers.

6.2 Insurance Coverage

Comprehensive travel insurance is included with all tours, covering medical emergencies, trip interruption, and evacuation. Detailed policy terms are provided upon booking.

6.3 Personal Property

Customers are responsible for personal belongings. Lipshand Luxury Tours is not liable for lost, stolen, or damaged personal property during tours.

7. Itinerary Changes

7.1 Right to Modify

Lipshand Luxury Tours reserves the right to modify itineraries due to weather, road conditions, safety concerns, or operational requirements. We will provide comparable alternative experiences when possible.

7.2 Accommodation Changes

If specified accommodations become unavailable, we will provide alternative lodging of similar or superior quality without additional cost to customers.

8. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and applicable Canadian privacy legislation. Customer information is used solely for tour operation and customer service purposes.

9. Dispute Resolution

9.1 Complaint Procedure

Concerns should be raised immediately with tour guides or company representatives. Post-tour complaints must be submitted in writing within 30 days of tour completion.

9.2 Governing Law

These terms are governed by the laws of Ontario, Canada. Any disputes will be resolved through binding arbitration in Toronto, Ontario.

10. Photography and Marketing

Customers consent to photography and video recording during tours for marketing purposes unless written notice to the contrary is provided. Images may be used in promotional materials, website, and social media.

11. Special Dietary and Accessibility Needs

We accommodate dietary restrictions and accessibility needs when disclosed at booking. Some remote locations may have limited accommodation options for special requirements.

12. Environmental Responsibility

Customers agree to follow Leave No Trace principles and respect wildlife, local communities, and natural environments. Violations may result in tour removal without refund.

13. Age Requirements

Most tours welcome participants aged 12 and older. Some experiences may have minimum age requirements for safety reasons. Children under 18 must be accompanied by an adult guardian.

14. Communication and Updates

Important tour information will be communicated via email and phone. Customers are responsible for monitoring communications and responding to requests for information.

15. Severability

If any provision of these terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
